Terms of Service & License Agreement

The short version
A summary, for orientation only — the numbered sections below are the actual agreement.

1. About these terms
RustyRecorder is made and sold by one person working under the name RustyRecorder (“we”, “us”). These terms cover the desktop app, this website, and any updates or support we provide — all of it called “the app” below.
By installing or using the app, you agree to these terms. If you don't agree with them, don't use it.
Buying a subscription is a separate transaction with Whop, and their terms cover the payment itself. See section 8.
2. What the app does
The app runs on your own computer. You give it channel links, it checks whether those channels are live, and when one is, it saves the stream to a folder on your own disk.
We never receive, store, or see anything you record. Your recordings are ordinary files on your own hardware, and they stay that way even if your subscription ends, the app is discontinued, or we stop operating.
The app is a tool. It has no idea which channels you point it at, and it makes no judgment about them.
3. Who can use it
You need to be 18 or older, and old enough to enter a contract where you live. Some sites the app can be pointed at carry adult content, and being old enough to view what you choose to view is on you.
If you're using the app for a company, you're confirming you're allowed to agree to these terms on its behalf.
4. Your license
While your subscription is active, you may install and use the app for your own purposes. The license is personal to you, and you can't transfer it to anyone else.
One license key works on one computer at a time. To move it, release the current device from Settings → Account in the app, or reset the key from your Whop orders page.
To confirm your license is valid, the app sends your key and an ID derived from your computer to us, and we pass it to Whop. That ID exists only to enforce the one-computer limit. If the app can't reach us — because we're down, or you're offline — it may not run until it can.
You're buying a license to use the app, not the app itself. We keep ownership of it.
5. What you can't do
Don't share, resell, or publish your license key, and don't copy or hand out the app itself.
Don't reverse engineer, decompile, or modify the app, except where the law says you may regardless.
Don't work around the licensing or the one-computer limit.
Don't use the app to get past a paywall, a subscriber-only section, DRM, or anything else meant to control access, and don't use it to reach content you aren't allowed to reach.
Don't use it to break the law, to break a platform's rules, or to harass or monitor anyone.
6. What you record is up to you
This is the part that matters most. You choose what to record, and everything that follows from that choice is your responsibility.
A livestream usually belongs to the person streaming it or to the platform carrying it. Whether recording one is allowed depends on what it is, where you live, and what you do with the file afterwards.
Keeping a copy for yourself and putting one in front of an audience are very different things. Don't re-upload, share, or make money from a recording unless you have the right to.
Following the law, and the rules of whatever platform you're using, is up to you. We can't give legal advice, and we're not telling you that any particular recording is fine where you are. If you're unsure, find out before you record rather than after.
Where a site carries adult content, the rules about consent and sharing are stricter, not looser. Recording someone is not permission to share it.
7. We're not connected to the platforms
RustyRecorder has no affiliation with Twitch, Kick, YouTube, TikTok, or any other site it works with, and none of them endorse it. Their names and logos belong to them.
Platforms change how they work whenever they like, without telling us. If one stops working with the app, that's a normal part of the territory rather than a fault in the app. We'll fix what we can.
8. Paying, renewing, and canceling
Subscriptions are sold through Whop, which takes the payment and issues your key. We never see your card details. Whop's terms and refund policy cover the purchase itself, and they're worth reading at whop.com/terms.
Your subscription renews automatically at the price you signed up for, and keeps renewing until you cancel. You can cancel any time from your Whop account, and you keep access until the end of the period you've already paid for.
Prices can change, but never for a period you've already paid for.
When a subscription ends, the app stops being licensed to you and deactivates. Your recordings aren't affected — they're plain .mp4 files and keep playing with or without a license.
We can suspend a key for non-payment, a chargeback, or a breach of these terms.
9. Your data
Almost nothing leaves your computer. The only thing we receive is the license check described in section 4.
We don't collect your recordings, your channel list, your file paths, or anything about what you watch. We have no way of reaching any of it.
Whop holds your account and payment details under its own privacy policy. We can see whether a key has an active subscription; we can't see your card.
While it's running, the app talks straight from your computer to the platforms you've added, to check whether they're live and to fetch the stream. Those requests go to them, not to us, and their own terms apply.
The optional web interface is off by default and serves your own local network only — nothing routes through us. You can set a PIN on it. If you turn it on, keeping that network safe is your job: anyone who can reach it can control the app.
This site runs no ads and no cross-site tracking.
10. Other software inside the app
The app includes some open-source components that handle part of the work. Each of them stays under its own open-source license, and where that license gives you rights in a component, it takes priority over these terms for that component. Email [email protected] and we'll send you the list and their license texts.
11. What we can and can't promise
The app is sold as is. We can't promise it will catch every broadcast, start at exactly the right moment, record without gaps, produce a flawless file, or keep working with any particular platform.
We may add, change, or remove features, and we may stop offering the app altogether. What we won't do is deliberately cut short a period you've already paid for.
The app isn't a backup service and makes no promise about keeping your files safe. Keep your own copies of anything you'd hate to lose.
Beyond what's said here, and as far as the law allows, we're not making any other warranties, spoken or implied. Some places, California included, don't allow certain warranties to be excluded, so parts of this may not apply to you.
12. Limits on our liability
If something goes wrong, we aren't liable for indirect or knock-on losses: lost recordings, lost data, missed broadcasts, lost profits, or a business being interrupted.
Our total liability for anything to do with the app is capped at whichever is more — what you paid us in the twelve months before the problem, or fifty US dollars.
Nothing here limits liability that can't legally be limited. Some places don't allow certain limits at all, so parts of this may not apply to you.
13. If your use causes us a problem
If someone brings a claim against us because of what you did with the app — what you recorded, what you shared, or a breach of these terms — you agree to cover what that lands us with, including reasonable legal fees.
14. Ending this agreement
You can stop whenever you like: cancel your subscription and uninstall the app.
We can end your license if you break these terms, particularly sections 5 and 6. Once it ends, stop using the app and remove it from your devices.
Sections 6, 7, 9, 10, 11, 12, 13, and 16 carry on applying afterwards.
15. Changes to these terms
We may update these terms. When we do, the date at the top of this page changes. Updates aren't backdated, and carrying on using the app means you accept them. If you'd rather not, cancel and uninstall.
16. Legal details
These terms are governed by the law of California, and any dispute between us goes to the state or federal courts there. That doesn't take away any protection your local law gives you that can't be signed away.
These terms, together with whatever Whop applies to your purchase, are the whole agreement between us about the app.
If part of these terms turns out to be unenforceable, the rest still stands. If we don't enforce something straight away, we haven't given up the right to.
We can transfer these terms if the business is sold. You can't transfer them without our agreement.
